III.             Public Comment

Mr. Patrick Fickel stated he was in favor of Dr. Thomen’s suggestion to put the Capital Outlay Tax question on the general election ballot in November so that more people could vote and that it would be more cost effective.

IV.              Approval of the Agenda

The agenda was approved as printed.

Mr. Peter requested that the Agenda be approved.  The motion was made, seconded and the agenda was approved as amended.

Agenda Item V-A.  Capital Outlay Question on August Ballot (tabled from June 24 Special Meeting)

At the March 18, 2004 Board of Trustees meeting, the Board adopted the resolution to levy a capital outlay tax not to exceed five (5) years and not to exceed two (2) mills and to have notice of such resolution published in accordance with state statutes.

The county clerk received a valid petition protesting the capital outlay tax, therefore, requiring the question to be voted upon at an election called for such purpose at special election including the next primary election, or general election.

Mr. Peter reviewed the events of the June 24 special Board meeting which led to tabling the Capital Outlay Tax.  Board Policy requires four votes to pass a resolution.  There was a motion to place the Capital Outlay Tax question on the November general election ballot.  The motion died for lack of a second.  The item was tabled until the entire Board could be present to make a decision. 

There was discussion regarding the additional costs associated with placing the question on the August primary election and that more people would probably vote in November. 

Resolution 2004-38

            RESOLVED, That the Protest Petition filed in response to the capital outlay resolution be accepted by the Board of Trustees of Neosho County Community College as a valid Petition, and that the question be placed upon the ballot for the next general election.

The motion was made and seconded that the above resolution be approved.  Motion passed unanimously.
